TERMS AND CONDITIONS – TREEHOUSE CLUBHOUSE

1. Introduction
Welcome to Treehouse Clubhouse! Our terms and conditions govern your use of our services, including our website, ticket purchases, party packages, and facility access. These terms are intended to ensure a safe, enjoyable, and fair environment for all our guests and staff. By accessing or using our services, you agree to be bound by these terms, which form a binding contractual agreement between you and Treehouse Clubhouse.
2. Acceptance of Terms
By using our services, you confirm your acceptance of these terms and conditions. If you do not agree to these terms, you must not use our services. Acceptance is indicated by any of the following actions: continuing to browse our website, purchasing any tickets online, registering an account, or booking a party package. Your continued use of our services following the posting of any changes to these terms constitutes your acceptance of those changes.
3. Modification of Terms
Treehouse Clubhouse reserves the right to modify these terms and conditions at any time. Such modifications will be effective immediately upon posting the revised terms on our website. We will make reasonable efforts to notify you of any significant changes via email or a prominent notice on our website. Your continued use of our services after any such changes have been made constitutes your acceptance of the new terms.
4. Account Registration (if applicable)
To access certain features of our services, you may be required to create an account. When registering an account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Treehouse Clubhouse immediately of any breach of security or unauthorized use of your account. Treehouse Clubhouse will not be liable for any losses caused by any unauthorized use of your account; however, you may be liable for the losses of Treehouse Clubhouse or others due to such unauthorized use.
5. Privacy Policy
Our Privacy Policy, explains how we collect, use, and disclose information that pertains to your privacy. By using our services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. We respect the privacy of our users and commit to protecting your personal data in compliance with all relevant laws and regulations.
6. User Conduct
As a user of our services, you agree to conduct yourself in a manner that is lawful, respectful, and considerate of others. You are responsible for all your communications and actions while using our services, including but not limited to adherence to our facility rules, online conduct, and interactions with other guests and our staff. Prohibited activities include, but are not limited to:
- Engaging in illegal activities or fraud.
- Distributing harmful or offensive content, including hate speech, harassment, or obscene material.
- Disrupting services or servers connected to Treehouse Clubhouse services.
- Using our services for any unauthorized commercial purposes. Violations of our conduct rules may result in immediate termination of your access to our services and legal action where appropriate.
7. Online Purchases
When you purchase tickets or book party packages through our website, you are agreeing to pay the stated price and applicable taxes. Prices and availability of tickets and packages are subject to change without notice. All purchases are subject to our cancellation and refund policies as outlined later in these terms. We employ secure payment systems to ensure the integrity and confidentiality of your payment information. By submitting your payment information, you authorize us to process your transactions and to make any inquiries we consider necessary to validate your account.
8. Payment Terms
When making purchases or bookings through our services, you agree to provide current, complete, and accurate purchase and account information. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Payments are due at the time of purchase or booking. We accept various forms of payment, which are listed on our website. Late payments, wrong bank, debit or credit card details, invalid credit/debit cards, or insufficient funds are your responsibility and may result in delayed or canceled services.
9. Cancellation/Refund Policy
All sales of tickets and party packages through Treehouse Clubhouse are final. Refunds or exchanges are not permitted except under specific conditions as outlined below:
- Event Cancellation: If an event or party is canceled by Treehouse Clubhouse due to unforeseen circumstances, a full refund will be provided to all ticket holders and party bookings for the specific date and time.
- Exceptional Circumstances: Refunds or credits may be granted in exceptional circumstances, such as severe illness or family emergency, at the discretion of Treehouse Clubhouse management. Such requests must be submitted in writing and include supporting documentation (e.g., a medical certificate).
- All sales are final. Any item or service purchased cannot be refunded, exchanged or disputed.
- You agree not to dispute credit card charges made on your behalf by Treehouse Clubhouse. Treehouse Clubhouse retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks.
- By ordering from us you agree not to dispute credit card charges of any kind. You agree that refunds will be issued at the discretion of Treehouse Clubhouse.
- Refunds may be considered pp to 2 months prior to booking: Full refund (Less 15% admin charge)
- Refunds may be considered up to 1 Month prior to booking: 50% refund (Less 15% admin charge)
- A full refund will only be given upon the production of a medical certificate less any upgraded food items order.
- Thereafter or default: No refunds
10. Party Policies
Booking a party at Treehouse Clubhouse requires adherence to the following guidelines to ensure a smooth and enjoyable experience for all:
- Reservations: All party bookings must be made at least four weeks in advance through our website or customer service team.
- Deposits: A non-refundable deposit is required to secure your booking. The balance must be paid in full at least one week before the party date.
- Capacity: Each party package has a maximum capacity. Additional guests may incur extra charges per person.
- Cancellations: Any cancellation of a party must be made at least two weeks prior to the scheduled date. Deposits are non-refundable but may be transferred to another date within six months, subject to availability.
- Use of cameras and video imaging equipment specifically within the party area and used by parents/guardians of children attending the party is permitted.
- Alcohol is not permitted to be consumed within children’s parties.
- Treehouse Clubhouse has the right to inspect and determine damages up to 24 hours after each event and to determine whether an outside vendor will be needed for repairs.
- If any portion of Treehouse Clubhouse, its facilities and equipment is damaged by any act, omission, default or negligence of the host, his/her agents, employees, patrons, or guests, the host shall pay Treehouse Clubhouse upon demand the cost of repairing the damages in excess of the security deposit.
- If the event extends beyond the above noted reservation time, the host will pay Treehouse Clubhouse $25 per quarter-hour for the time that the event extends beyond the reserved time that may collected directly from the host to Treehouse Clubhouse by the end of the event.
- No decorations may be “pinned” or nailed to any surface including taped or hanged from the walls.
- No open flames.
- No glitter or confetti.
- No helium balloons
11. Nut-Aware Facility Policy
Treehouse Clubhouse is committed to providing a safer environment for children with nut allergies, but we are not a nut-free facility. We ask all patrons to refrain from bringing nut-based products into the facility. However, Treehouse Clubhouse cannot guarantee the absence of nuts or other allergens and is not responsible for allergic reactions or cross-contamination that may occur.
12. Supervision Requirements
All children under the age of 13 must be accompanied and supervised by a parent or guardian at all times while at Treehouse Clubhouse. Supervisors must ensure their wards adhere to the facility’s safety rules and regulations. Unsupervised children will be brought to the attention of facility staff and must be collected promptly by their guardians.
13. Waiver Policy
To participate in any activities at Treehouse Clubhouse, all visitors, both children and adults, must sign a liability waiver. This waiver acknowledges risks associated with the activities and releases Treehouse Clubhouse from liability for any injuries sustained. The waiver must be signed prior to entry and is legally binding. Parents or guardians must sign waivers on behalf of their minor children.
14. Safety and Health Compliance
Our commitment to your safety and health is paramount. We adhere to applicable health and safety laws and regulations to ensure our facility remains a safe environment for all guests and staff. This includes regular maintenance and sanitation of our equipment and facilities. Patrons are expected to contribute to these efforts by complying with all posted rules and verbal instructions from staff regarding health and safety protocols.
15. Facility Use Guidelines
Treehouse Clubhouse provides specific guidelines for the use of our facilities to ensure a safe and enjoyable environment for all guests:
- Food and Beverage: No outside food or beverages are allowed within the facility unless explicitly permitted as part of a party package. This policy helps manage potential allergens and maintains cleanliness.
- Appropriate Attire: Guests are required to wear socks in play areas at all times. We also recommend comfortable clothing that does not impede movement or safety.
- Stroller Parking: Strollers must be parked in designated areas to avoid blocking pathways and exits.
- Compliance with Staff Instructions: All visitors must comply with directions from staff members related to facility operations, safety rules, and emergency procedures.
16. Decorations and Party Conduct
To ensure the safety and enjoyment of all our guests, we have specific guidelines for decorations and conduct during parties:
- Decorations: Decorations are welcome but must not cause damage to the facility. No nails, staples, or tape that could leave marks or residue are allowed. All decorations must be removed at the end of the event.
- Conduct: Party hosts and guests are expected to behave in a manner that does not disrupt the enjoyment of others. Loud music or noise, disruptive behavior, and inappropriate activities are not permitted.
17. Admission and Access
Treehouse Clubhouse reserves the right to manage admission to the facility as needed:
- Right to Refuse Entry: We reserve the right to refuse entry to any individual who does not comply with our terms and conditions or who poses a potential threat to the safety or enjoyment of other guests.
- Re-entry: Guests who leave the facility may not be allowed re-entry during busy times or under specific circumstances that would disrupt facility operations.
18. Behavioral Expectations
All guests are expected to conduct themselves in a respectful and orderly manner. Inappropriate behavior, including but not limited to harassment, physical or verbal abuse, or any form of discrimination, will not be tolerated and may result in immediate removal from the premises and potential legal action.
19. Damage and Liability
Guests are responsible for any damage they cause to the facility or its equipment:
- Reporting Damage: Any damage must be reported to a staff member immediately.
- Financial Responsibility: Guests may be financially responsible for repairs or replacements needed due to their actions.
- Liability Limitation: Treehouse Clubhouse is not responsible for personal injuries or damage to personal property that occurs as a result of individual actions that violate our guidelines or through disregard for safety instructions.
- Treehouse Clubhouse cannot accept any liability for the loss, damage or theft of any items. Please take care not to leave belongings behind or unattended, and please do not bring valuables to the center.
20. Emergency Procedures
Treehouse Clubhouse has established emergency procedures to respond to various situations:
- Emergency Exits: All emergency exits are clearly marked and should remain unobstructed at all times.
- Staff Training: Our staff are trained to handle emergencies and will guide guests in the event of an incident.
- Guest Cooperation: During an emergency, all guests are required to follow the instructions of staff members to ensure everyone’s safety.
21. Intellectual Property
The content provided through Treehouse Clubhouse’s services, including graphics, logos, images, and text, is the property of Treehouse Clubhouse and is protected by copyright and other intellectual property laws:
- Use Restrictions: Guests may not reproduce, distribute, modify, or use the content of our services without express written permission from Treehouse Clubhouse.
- Trademark Notice: The Treehouse Clubhouse name and logos are trademarks of Treehouse Clubhouse. Unauthorized use is prohibited.
22. Dispute Resolution
In the event of a dispute arising from or related to the terms and conditions or the use of Treehouse Clubhouse services, both parties agree to pursue an amicable resolution through informal negotiation. If the dispute cannot be resolved informally within a reasonable timeframe, it shall be resolved through binding arbitration. Arbitration shall be conducted:
- Location: In the jurisdiction where Treehouse Clubhouse is located.
- Rules: According to the rules of an agreed-upon arbitration body.
- Finality: The arbitrator’s decision will be final and binding, and no party shall have the right to litigate that decision in court or have a jury trial.
- Dispute Confidentiality: All aspects of the arbitration process shall remain strictly confidential between the parties and the arbitrator.
23. Termination of Use
Treehouse Clubhouse reserves the right to terminate or suspend access to our services without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms and conditions. Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service. All provisions of the terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
24. Miscellaneous Provisions
- Severability: If any provision of these terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
- No Waiver: Failure by Treehouse Clubhouse to enforce any right or provision of these terms will not be considered a waiver of those rights.
- Assignment: Treehouse Clubhouse may assign or delegate these terms and/or the Treehouse Clubhouse Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without Treehouse Clubhouse’s prior written consent, and any unauthorized assignment and delegation by you is void.
- Headings: Headings and titles are provided in these terms for convenience only and should not be considered in interpreting the agreement.
